SHIPPING AND DELIVERY

At this time, Marinelock LLC ships merchandise only to locations within the United States and certain Foriegn Countries. Marinelock LLC will ship to Alaska, Hawaii, Puerto Rico, Guam or the US Virgin Islands, at an additional cost. The title and risk of loss for all merchandise ordered on this Web site will pass to you when the merchandise is delivered to the shipping carrier (FOB Shipping). International purchasers agree to pay any import duties, taxes or customs fees associated with their purchases.

SALES TAX

Marinelock LLC must collect sales tax for merchandise ordered on this Web site based on the applicable state sales tax rate and the location to which the order is being shipped. If a valid resellers agreement is in place we will waive tax collection.

SAFETY

NOTICE: The customer is responsible for proper installation at all times, Marinelock is in no way responsible for damage to you or to your property due to improperly installed products.

NOTICE: Marinelock products are not to be used to restrain or secure your boat, overhead lifting or equipment for storage, the removal force shown in the specification sheet is for informational purposes only. (example: do not tie your boat’s dock line to a Marinelock Cable, or for example; do not use a Marinelock Security Clip to restrain a Kayak onto the boat deck or trailer while underway.)

WARNING: Some Lockitdown™ kits and packages contain a very strong, quick bonding, liquid adhesive. Avoid contact with skin and eyes. Keep away from children.

RETURN POLICY

Standard Product Return Policy:

Any unopened and unused products listed in the Marinelock catalog may be returned for a refund for suitable reasons. All returns require a return authorization number, contact us at support@marinelock.com for this number. Customer will be responsible for, or billed for, any shipping and handling charges involving a returned item including outbound shipping of exchaged products. A 15% restocking fee will be applied to all returns requesting refunds, there is no restocking fee for items being returned for exchange of similar products.

Defective Products:

· We will repair or replace the product at our discretion within 2 years of purchase date on cables, clips and locks in our Lockitdown™ product family. The Sonic Shock™ Alarm will be repaired or replaced if found defective within 1 year of purchase. STOP™ Tags have a lifetime warranty, and provide a transferable, lifetime, web based tracking capability to the owner of the product carrying the tag. We will repair or replace failed components at our discretion.

Our Products damaged during a Theft:

Return our damaged products to us we will replace them with equal or replacement components at no charge. Please provide copy of the Police report for this replacement offer. This is for our products only, not any lost or damaged equipment that was being secured. Contact us for a return authorization number, support@marinelock.com .

Please be advised that all orders are pre-paid by using PAYPAL, Google Checkout, MasterCard, Visa or American Express. We do not provide credit. Marinelock LLC reserves the right to change its payment procedures at any time without prior notice to you.

MISCELLANEOUS

VOID WHERE PROHIBITED:

Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. Marinelock LLC and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. GOVERNING LAW:

In the event of litigation both parties agree that the Law of Michigan shall apply and both parties consent to the jurisdiction of the state courts of Chippewa County, Michigan, or in the event of diversity of citizenship, the United States District Court for the Western District of Michigan, Northern Division, (Marquette). Both parties expressly waive a trial by jury.

MISCELLANEOUS:

The Terms and Conditions constitute the entire agreement between you and Marinelock LLC with respect to this Web site. The Terms and Conditions supercede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Marinelock LLC with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Marinelock LLC. RESELLER REGISTRATION:

Send an email to our support@marinelock.com requesting our reseller application. After receipt of the completed application and a copy of your Sales Tax Exemption certificate we will provide details and access to our reseller program. Please be advised that all orders are pre-paid via PAYPAL, Google Checkout, MasterCard, Amex or Visa, we do not process purchase orders nor provide credit. Warranty

MARINELOCK LLC’s COMMITMENTS

1. The product when shipped will meet Marinelock LLC’s then current Specification Sheet.

2. Marinelock LLC will notify the customer if the product specification sheet has changed.

3. Marinelock LLC will provide copies of, or web link access to the current material safety data sheet (MSDS).

4. Marinelock will convey the product with good title, free from any lawful lien or encumbrance.

EXCLUSION OF ALL OTHER WARRANTIES

THE COMMITMENTS ABOVE ARE MARINELOCK LLC’S SOLE WARRANTIES RESPECTING TO THE PRODUCTS INCLUDING WITHOUT LIMITATION, PRODUCT QUALITY AND PERFORMANCE AND ARE MADE EXPRESSLY IN LIEU OF AND EXCLUDE ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ALL OTHER EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES PROVIDED BY STATUTE OR COMMON LAW. CUSTOMER ASSUMES ALL RISKS AND LIABILITIES RESULTING FROM THE USE OF THE PRODUCT DELIVERED HEREUNDER.

LIMITATION OF LIABILITIES

NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR ANY CONSEQUENTIAL, PUNITIVE, SPECIAL, EXEMPLARY, OR INCIDENTAL DAMAGES. CUSTOMER’S EXCLUSIVE REMEDY AND MARINELOCK LLC’S TOTAL LIABILITY FOR CLAIMS REGARDING A PRODUCT’S FAILURE TO MEET SALES SPECIFICATIONS, QUALITY OR PERFORMANCE (INCLUDING BREACH OF WARRANTY, NEGLIGENCE AND STRICT LIABILITY) IS LIMITED TO CUSTOMER HAVING THE OPTION OF REPLACEMENT OR REPAYMENT OF THE PURCHASE PRICE PAID FOR THE PRODUCTS WHICH ARE SUBJECT TO THE CLAIM.

NOTICE OF CLAIMS

WITHIN 60 DAYS AFTER CUSTOMER LEARNS, OR SHOULD REASONABLY HAVE LEARNED, OF ANDY CLAIM WITH RESPECT TO PRODUCTS, CUSTOMER WILL INFORM MARINELOCK LLC IN WRITING THE CLAIM OR THE CLAIM IS WAIVED.
